The Industrial Court has ruled that Flash Malaysia Express Sdn. Bhd. acted with just cause in dismissing a branch supervisor accused of workplace sexual harassment.

The employee, Amiruzzaki Bin Khairiel, was terminated in December 2024 following an internal investigation into inappropriate messages sent to a female subordinate. While one serious allegation involving an explicit verbal proposition was not proven, the court found that two other incidents — including calling the employee “sayang” (darling) and sending a sexually suggestive message — amounted to verbal sexual harassment.

In its decision, the court stressed that even seemingly casual or joking language can be inappropriate in a professional setting, especially when it involves a superior-subordinate relationship.

The court concluded that the misconduct was serious enough to justify dismissal, highlighting the importance of maintaining professionalism and respect in the workplace. The employee’s claim of unfair dismissal was therefore rejected.
